£13,400 won in compensation after laser hair removal causes severe burns
The accident
We recently helped claim compensation for a client who was injured whilst visiting a salon for hair removal treatment. She had been to the salon a number of times before and had also undergone laser hair removal in the past. On this occasion, she noticed that the temperature felt warmer and more painful than usual. After expressing her concerns, the therapist advised her that the machine had been serviced and it was nothing to worry about.
The injury
Despite being reassured, our client suffered from severe second degree burns down both of her arms which were blistered and covered in rectangular, horizontal stripes. She was in pain and suffered from itchiness for 3 weeks. She described her stripes to that of a zebra, which left her feeling embarrassed as they were visible and affecting her daily life. As a result, she was unable to attend social events as she felt conscious about their appearance. In addition to this, her work was affected as she could not meet clients.
Therefore, as well as physical injuries, our client suffered psychological effects too; including feeling anxious and upset and her mood became very negative.
How we helped claim compensation:
Actons pursued the salon on the basis that the salon had negligently carried out treatment without taking precautions to check whether the machine was too hot. We updated our client throughout the process and even arranged for her to see a plastic surgeon to discuss treatment for her scarring. In addition to this, we obtained a quote for correctional behaviour therapy to help her with her anxiety and mood.
The salon offered £3,500 to settle the claim, however, we advised her to reject this offer. After issuing court proceedings and continuing to collect evidence to strengthen her claim, we secured a much larger settlement of £13,400.
