£1,500 compensation secured after a customer at an Indian restaurant breaks a tooth on food
The accident:
We acted for a client who had been injured after visiting her local Indian restaurant in July 2017.
She had ordered a curry with naan bread and was enjoying her meal until she took a bite out of the bread and unexpectedly bit into a piece of clay.
The injury:
Much to her dismay, she soon realised that what she had bitten into was in fact from the restaurant’s clay oven.
Breaking away from the restaurant’s oven during cooking, the clay had fallen into our client’s food; resulting in her back tooth being broken.
Her injuries required a filling but no further medical treatment was needed after this and she went on to fully recover from the injury.
Symptoms were experienced for a total of 16 days.
How we helped claim compensation:
We submitted a claim to the restaurant who admitted the accident was their fault. They made an offer of £1,500 compensation to settle the claim which our client was happy to accept.
The settlement amount was considered to be generous since she had not incurred any financial expense from the accident and her injury had fully recovered by 16 days after the accident.
