£40,000 compensation won after falling on damaged pavement
The accident
We were contacted by a man who suffered a fall whilst walking along a public footpath. a large area of tarmac on the pavement was damaged, causing the man to trip and sustain some unpleasant injuries.
The injury
Sadly, the man suffered from severe soft tissue injuries to both of his knees which affected his ability to walk. He also hurt his right shoulder, right elbow and left wrist. These injuries meant that the man struggled to carry out daily activities, including being able to work, resulting in a loss of income.
How we helped claim compensation
Actons Injury Solicitors contacted the local council as they were responsible for the condition of the pavement. By allowing it to become damaged, the local council put members of the public at risk, presenting great danger to anyone walking along the path.
The council admitted to this legal responsibility and offered a sum of £30,000 as compensation for the man’s injuries and losses. However, we were advised that this amount undervalued the suffering caused by the accident so continued to carry out some further negotiations.
The council then used a forensic accountant to review the man’s accounts. The reason for doing this was because the loss of income accounted for a significant amount of the final compensation he would receive.
After reviewing the report from the forensic accountant, the council increased its offer to £40,000. This was a much better representation of the man’s losses and suffering, which he agreed. Therefore, the man was awarded £40,000 in compensation for his fall on the pavement.
