A woman instructed us to bring a claim arising out of a road accident. She was cycling along a road when the Defendant opened his car door into her path, causing a collision.
Our client sustained nasty injuries including a severe cut to her face and an injury to her hip.
Before the accident, she had had problems with her hip and pelvis. The accident made them worse.
We sent a letter of claim to the car driver and his insurers. They disputed liability for the accident. They said that the Defendant’s door was already open and that our client should have seen it.
Her injuries were particularly significant as she was a secondary school teacher. The injury to her face caused her embarrassment at work. The injuries did not recover as quickly as anticipated and she needed surgery to her hip and cosmetic surgery to her face. The cosmetic surgery was not readily available on the NHS and so the cost of this was included in her claim.
We were successful in settling the claim for £18,000. This included the cost of cosmetic surgery which she is now able to have on a private basis. We also claimed for domestic care and assistance given to her by her husband and her loss of earnings. We acted for her on a No Win No Fee basis. The insurers also paid our costs.
