Our client was performing a routine dumbbell press exercise but on bringing the dumbbell to the floor, his index finger got caught between the dumbbell and a piece of equipment which had been negligently left by other members. He suffered a laceration to his finger which resolved 6 months after the accident.
After receiving our detailed letter of claim, the gym denied it was their fault on the basis that they had no record of our client’s membership.
The information identifying our client’s legitimate gym membership was obtained and sent to the gym. However, they continued to deny liability, stating that they were of the opinion our client was using a weight that was clearly too heavy for him and as a consequence, dropped it onto his own finger.
We issued court proceedings and continued to argue that the gym was liable in so much that the accident could have been avoided if they had performed their contractual duty and kept the area clear.
The case wet to trial, where the judge proceeded to find the gym liable and awarded our client £1,750.35 in compensation.
