The accident:
The mother of an 8 year old came to us looking to claim compensation for her daughters injuries at a Pizza Express outlet in Devon.
The waitress brought out a hot pizza and handed it to the girl instead of placing it on the table or passing it to her father.
As she was unable to hold the pizza, it fell on her thigh causing injuries.
The injury:
The girl suffered minor burns to her right thigh and secondary scarring.
Due to the blistering, she attended the local Minor Injuries Clinic for the burn to be dressed.
The burn healed in 4 weeks but left minor scarring which would mature over a period of 18 months.
The medical expert also confirmed that some permanent scarring will remain with peripheral pigmentation around it.
How we helped claim compensation:
We pursued the claim for compensation on the basis that Pizza Express had failed to adequately train their staff.
The waitress was at fault as she did not place the hot pizza on the table, failing to anticipate that the child would drop it.
We ensured that the girl’s mother was updated throughout the process and arranged for her to see a private medical expert, without a long waiting list.
We also sought the opinion of a barrister who valued the claim at £2,400 to £2,800.
After incessant negotiation with Pizza Express, we were able to secure £3,500 in compensation..
This money was placed in a trust fund for the young girl and will be available for her once she turns 18, plus the interest it gains.
