We were instructed on a No Win No fee basis to act on behalf of a client in connection with a dog biting claim that took place last year. Our client was due to go on holiday and had gone out for a run prior to going away. As she was running down the road she went to pass the Defendant on the pathway who was out walking his dog. His dog was on quite a long lead. Our client requested to pass by and as she did so the Defendants dog bit her on the leg.
Due to the bite our client had a large chunk taken out of her leg which she had to undergo treatments at the hospital including skin grafting. Whilst treatment was ongoing, she contacted us to pursue a claim against the Defendant.
We pursued the Defendant with a detailed letter of claim setting out specific allegations of failing to control his dog, allowing it to bite our client amongst many other allegations all of which were disputed. The Defendant denied being responsible for the incident on the basis that the dog was on a lead, he was in control and that his dog was not a threat to our client.
We then obtained medical evidence along with the police report and compelling evidence from the Claimant with a view to issuing Court proceedings. Upon setting out full details of her claim including the need for surgery in the future and the fact that we were in a position to issue court proceedings unless they accepted fault, offers were then made by the Defendant. After negotiations the claim settled for £16,000 which included provision for surgery in the future. Our client was very happy with the outcome.
