We were instructed to act on behalf of a client in connection with a dog-biting incident that occurred in the summer of 2018. He was attending an appointment at a property through his work. As he rang the doorbell of the property, a dog jumped up at the door from the other side and caught the door handle with its paw, causing the door to open. It seems likely that the dog had done this before as the door was fitted with an additional latch but the owner had failed to secure it that day and the dog escaped and attacked our client, biting him on his stomach.
We were instructed to act on behalf of him on a No Win, No Fee basis and wrote a letter of claim to the dog’s owner, setting out the circumstances of the incident and our reasoning for considering them at fault. The dog owner’s insurance had lapsed, leading them to instruct solicitors to manage the matter on their behalf. Liability for the incident was subsequently admitted.
Medical evidence was thereafter obtained in respect of both physical and psychological injuries and disclosed to the Defendant’s Solicitors. Our client had left his job and been forced to retrain and find alternative employment due to his fear of dogs. No offers to settle the claim were received from the Defendant’s Solicitors, so it was necessary to issue Court proceedings. Shortly before the Trial, the solicitors accepted our costs-inclusive offer of £18,000, bringing our client’s claim to a successful conclusion.
