The accident

A gentleman contacted our team at Actons Injury Solicitors after he slipped on a wet floor in a hotel toilet whilst he was celebrating a family members wedding at the hotel. He entered into the bathroom and did not notice the wet floor as there were no signs out and it wasn’t evident, slipped over and suffered a significant injury to his knee.

The injuries

The gentleman suffered a periprosthetic fracture to the left knee having had a previous total knee replacement. He spent 4 weeks in hospital and had to undergo complex surgery to repair the fracture and revise his knee replacement. Fortunately this was all undertaken on the NHS immediately after the accident. The Claimant continued to experience significant pain in the left knee and contacted us to pursue a claim on a No Win No Fee basis as at the time he felt that nobody took at the hotel took his injury seriously. The Claimants injuries left him with difficulties walking and standing for long periods. The residual symptoms he was left with were expected to be permanent albeit the gentleman had a longstanding history of arthritis.

How we helped him claim compensation

We acted for the gentleman on a No Win No Fee basis and submitted the claim to the Defendant hotel themselves. Insurers were instructed. We argued that they had failed to clear the water spillage from the floor, failed to have any sufficient inspection regime in place which would or ought to have brought the spillage to their attention and ensured it was cleared prior to the Claimant slipping over, they created a slipping hazard and a foreseeable risk of injury and failed to guard the area or leave any signs out to warn the Claimant of the potential risk of a wet floor.

The hotel involved initially disputed liability for the incident for some time and we obtained Witness evidence from family members and others who were also at the wedding. Eventually the hotel conceded liability and our client received £27,500.00 in respect of his injury claim.
