We were instructed to act on behalf of the client in connection with a dog biting claim which
occurred in the summer of 2021. Our client was walking along the retail park with his son when
they walked past a family which had a Rottweiler type dog on a lead. As they walked by, the
Rottweiler growled and jumped up at our client and bit him.
We were instructed to act on behalf of the client on a No Win, No Fee basis and wrote a letter of
claim to the Defendants setting out the circumstances and why we considered they were at
fault for the incident. The Defendants denied liability, alleging that the circumstances of the
incident did not happen as alleged by our client.
Fortunately, our client had reported the matter to the Police and Police evidence was obtained.
This was supportive of his version of events rather than the Defendants. Veterinary
records were also obtained for the dog in question. Comments were made in the vet records
as to the dog’s characteristics which we argued meant it had a propensity to bite.
Medical evidence was therefore obtained with the view that if the Defendants insurers did not
settle the claim we would issue Court proceedings. This revealed that our client had suffered a
minor scar to his arm and ongoing anxiety and weariness with regard to dogs in general.
The Claimant required help with treatment for anxiety suffered from the incident which we
looked to help him with.
Upon receipt of medical evidence and strong correspondence setting out our views, the
Defendants accepted that they were at fault and made an offer to settle our client’s claim in the
sum of £6,000.00 which the Claimant accepted. This included provision for rehabilitation
treatment required to help him overcome his anxiety.
Our client was happy with the outcome.
