We were instructed to act on behalf of the client in connection with a dog biting claim that occurred in 2021. The client, through his employment, was required to visit the defendant’s property, and this visit was prearranged. Upon arrival at the property, our client could see a German Shepherd dog sitting in the window and barking loudly. The dog continued to bark at the door of the room when the client was invited in. The owner of the dog suggested the dog would be better and would calm down if the dog saw him. He asked our client if he was comfortable with dogs, to which he confirmed that he was. Upon the owner opening the door and releasing the dog, it immediately attacked our client, biting him on his arm. The owner had a hold of the dog by its harness, which he used to remove the dog and take it outside.
We were instructed to act on behalf of the client on a No Win, No Fee basis and wrote a letter of claim to the defendant setting out the circumstances of the accident and why we considered he was at fault for the accident. The defendant confirmed that this matter had been passed to his pet insurers to deal with, but unfortunately, the insurers took quite a long time to acknowledge and deal with the claim initially.
Once the insurers finally began dealing with the claim, shortly afterwards, liability was accepted, subject to proving the injury. We then took steps to obtain medical evidence to support our client’s claim. Upon receipt of medical evidence, the defendant made a low offer of £4000.00. After negotiation, we were able to secure our client a settlement of £6000.00. The client was happy with the outcome.
