The Accident
A gentleman contacted out team at Actons Injury Solicitors after he suffered major injuries to his leg due to his shopping trolley colliding with a metal holder that was protruding from a shelf.
He was walking down an aisle in B&Q which had a number of metal poles protruding from the bottom of the shelf to act as trolley holders. Due to the holders being so low to the ground and the fact that the Claimant was pushing a trolley at the time, he was unable to see these holders which resulted in his trolley colliding with it and knocking back into him, causing him to fall to the ground.
The Injuries:
The trolley collision resulted in the Claimant suffering from bruising and pain to his back and right leg and a laceration to his ankle as well as causing him to develop a haematoma which required a three unit blood transfusion.
How We Helped Claim Compensation:
The gentleman contacted us to discuss how he could go about claiming compensation for his injuries following the incident.
Our team of specialist personal injury lawyers agreed to help him claim compensation on a No Win No Fee basis.
B&Q disputed the claim on the basis that there was no CCTV evidence or witnesses to the event taking place and the removal of the pins would result in their being an even greater health and safety risk. They further stated that our client himself was at fault and should have acted more reasonably to avoid this injury. However, our specialist injury lawyers compiled compelling medical evidence and witness statements and were satisfied that the claim had merit and continued pursuing the claim.
We were successful with the claim and settled the claim for £2,500.
