The Retail Accident
A man contacted our specialist team of retail personal injury lawyers after an accident at his local M&S Foodhall.
As he was walking along the aisle, he caught his lower leg on a protruding wire display basket. The framework of the basket was welded, creating a serrated edge.
As a result, the man suffered a nasty cut to his shin requiring hospital treatment to have the wound cleaned and dressed.
He was self-employed and unable to work for 2 weeks as a result of his injury and we were able to prove his loss of earnings.
How We Helped Claim Compensation
We arranged for him to be examined by a Consultant Plastic Surgeon who prepared a report dealing with the injury suffered and providing an opinion in relation to the residual scarring.
We presented our client’s claim to the insurers, providing them with the medical evidence together with details of his losses. The insurers eventually conceded liability for the accident.
The insurers made an initial offer of £3,080.65 which we considered to be too low. We felt he would achieve a higher award by taking the case to Court.
We were able to negotiate an increased offer of £4,500.00, without the need to go to court, which the client was very happy with.
