£5,500 compensation for an accident in Matalan store
We secured £5,500 compensation for a lady who was injured at a Matalan store in Greater Manchester.
She fractured her ankle when she caught it on a corner of a display unit in the shop. The clear perspex lower shelf, protruded out into the walkway, presenting a hazardous environment for nearby shoppers. We based the claim on the hazardous design of the display unit at the shop.
Matalan denied liability throughout the case arguing that the display unit was a standard fixture in all of their stores. We issued court proceedings and they filed a defence. However, before the disclosure of all documents, investigations revealed that the unit in question had since been modified in the same Matalan store our client incurred her injuries.
The new design eliminated the protruding aspect of the perspex shelf. This affirmed our basis of the argument that the unit at the time of the accident, was unsafe to the public.
As a result, we had sufficient evidence to negotiate a £5,500 settlement of the claim without going to court.
