We acted on behalf of a woman who slipped on what she thought to be an item of food that had not been cleaned off the floor of a coffee shop. As a result of her fall, she injured her chest and ribs, suffered a friction burn on her hand and wounds to the leg and chin, which left a dint in the skin.
Her chest injury recovered within 6 weeks of her accident however the injury to her ribs did not resolve until 3 months after the accident. The bruising to her chest meant that for about 3 weeks, she could not drive or wear tight clothing as the pain was too severe.
The coffee shop denied it was their fault on the basis that it is not possible for them to check and clear every item on the floor at all times.
Our client however notified us that she was in the shop for over 15 minutes before the accident happened and neither her or her friend had seen any members of staff clearing up. This account of events suggested that any cleaning regime they have, had not been adhered to and they had been negligent in their duty towards their customers.
We were satisfied that we had strong evidence to support her claim and so wrote to the coffee shop detailing her account of events.
They still did not admit liability, but instead we negotiated a settlement out of court. We made an offer of £2,000, which was accepted and our client received the amount in compensation.
